Terms and Conditions
Conditions for purchasing event packages from Pickudu. Last updated: July 2026.
[LEGAL REVIEW] These terms are a placeholder draft and must be reviewed by a lawyer and adapted to the actual offering before go-live.
1. Scope
These terms and conditions apply to all contracts for the use of the "Pickudu" service offered through this website, concluded between Vorster Consulting GmbH ("we", "provider") and the customer ("you", "host"). Deviating terms of the customer apply only if we expressly agree to them in writing.
2. Description of services
Pickudu is a web-based service for collecting and displaying photos together at events. Guests upload media via a QR code without installing an app, and the photos are shown in a live slideshow. The scope of features depends on the booked package (Chill, Vibe, Epic). We owe the provision of the service for the duration stated in the package, not any particular economic outcome.
3. Conclusion of contract
The presentation of packages in the shop does not constitute a binding offer. By completing the checkout you submit a binding offer. The contract is concluded upon our confirmation by e-mail or upon provision of your access credentials.
4. Prices and payment
The prices shown in the shop at the time of ordering apply. All prices include statutory VAT. Payment is made via the payment methods offered at checkout. It is a one-time payment per event with no automatic renewal.
5. Obligations of the host
As the host you are responsible for informing your guests about the photo collection and – where required – obtaining their consent. You ensure that no unlawful, offensive or rights-infringing content is uploaded through your event access, and you use the provided moderation features at your own discretion.
6. Content and rights
The rights to uploaded media remain with their respective creators. We process the content exclusively to provide the service (see Privacy Policy). We are entitled to remove content that is evidently unlawful.
7. Availability
We strive for high availability of the service but cannot guarantee uninterrupted accessibility, in particular during maintenance work or disruptions beyond our control.
8. Right of withdrawal
Consumers have a statutory right of withdrawal. For digital services, the right of withdrawal may expire early if performance has begun with your express consent before the end of the withdrawal period. Details and the model withdrawal form are provided during checkout. [LEGAL REVIEW]
9. Liability
We are liable without limitation in cases of intent and gross negligence as well as for injury to life, body and health. In cases of slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. Any further liability is excluded. [LEGAL REVIEW]
10. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
